Terms and Conditions of Sale

Preamble

The company Groupe IJP, with its registered office at Cours Saint-Michel 30b, 1040 Etterbeek, Belgium, registered with the Crossroads Bank for Enterprises under number BE1009.934.603 (hereinafter referred to as "RenovSmart"), operates a web and mobile platform called RenovSmart.

These terms and conditions of sale (hereinafter referred to as "TCS") govern the contractual relationship between RenovSmart and its clients (hereinafter referred to as "Client") and define the respective rights and obligations of the parties concerning the sale of services offered through the platform.

Article 1: Purpose

These TCS define the terms for subscribing to, using, and paying for the services provided by RenovSmart, including:

  • Connecting users with renovation and construction professionals.
  • Subscription to premium services for professionals.
  • Management of reviews and quote requests.

Any order implies full and unconditional acceptance of these TCS by the Client.

Article 2: Services and Pricing

RenovSmart offers both free and paid services. Paid services include:

  • Premium Subscription: Access to additional features such as profile promotion and performance analysis (annual fee: €249 excl. VAT).
  • Visibility Options: Sponsored ads and targeted advertisements.

Prices are quoted in euros and are subject to applicable VAT. RenovSmart reserves the right to modify its pricing. Any changes will be communicated to the Client at least 30 days before implementation.

Article 3: Orders and Payments

Orders are placed online via the platform. The Client receives an order confirmation by email.

Payment: Payments are secure and can be made by credit card or bank transfer. In case of non-payment, RenovSmart reserves the right to suspend access to services until payment is made.

Billing: Invoices are provided electronically and sent via email.

Article 4: Duration and Termination

Premium subscriptions are valid for one year and renew automatically unless terminated in writing via email to [email protected] at least 30 days before the end of the current term. RenovSmart may terminate or suspend a subscription in case of serious breach by the Client of these TCS, without prejudice to claims for compensation.

Article 5: Responsibilities

RenovSmart acts solely as an intermediary between users and registered professionals. The company cannot be held liable:

  • For information provided by professionals.
  • For disputes between Clients and professionals.
  • For temporary interruptions of the platform for maintenance or improvements.
  • For the lack of guaranteed minimum inquiries or commercial results.

The Client is responsible for the accuracy of the information they provide on the platform.

Article 6: Intellectual Property

All content on the platform (texts, images, logos, etc.) is protected by copyright. Any reproduction, even partial, is strictly prohibited without written authorization from RenovSmart. Businesses retain ownership of their content (photos, videos) but grant RenovSmart a non-exclusive license for promotional use.

Article 7: Personal Data Protection

RenovSmart commits to processing personal data in compliance with the GDPR. Collected information is used solely for providing the offered services. Clients have the right to access, rectify, and delete their data by contacting [email protected].

Article 8: Force Majeure

RenovSmart shall not be held liable for delays or failures to fulfill its obligations in the event of force majeure (natural disasters, cyberattacks, etc.).

Article 9: Complaints and Disputes

In the event of a dispute, the parties agree to seek an amicable solution before initiating legal proceedings. Failing this, any dispute shall be submitted to the exclusive jurisdiction of the courts of Brussels.

Article 10: Right of Withdrawal

In accordance with legislation, consumers have a 14-day withdrawal period after subscribing. However, by accepting immediate access to paid services, the Client expressly waives their right of withdrawal.

Article 11: Subcontracting and Partners

RenovSmart may use subcontractors or partners to provide maintenance, hosting, and other technical services. These partners are contractually bound to comply with confidentiality and data security requirements under GDPR.

Article 12: Amendments to the TCS

RenovSmart reserves the right to modify these TCS. Any changes will be published on the platform and notified to the Client.
